Currently, women on average are making 80 cents for every dollar a man makes. Due to this equal pay is a need and we must fix this issue. To do this we need to pass the Paycheck Fairness Act. The bill is currently sitting around congress, where it could be fixing several of the holes that cause the pay gap for genders. In the bill it states to “ (1) restrict the use of the bona fide factor defense to wage discrimination claims, (2) enhance nonretaliation prohibitions, (3) make it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee’s wages, and (4) increase civil penalties for violations of equal pay provisions.” The first part of the bill already goes to the root of the problem which is discrimination when it comes to paying, which in this cause is due to gender. Part of the PFA would change wage transparency, whereas with the with PFA there would be advertising the salary with the job listing. In most scenarios’ men are more likely to of negotiating for a higher wage than for women, and when women do decide to negotiate, chances are they might get penalized. However, with salary already advertised with the job listing, this removes that salary being offered differently based on sex. The PFA would also hinder the ability of the employer to figure out the employee’s previous wage. Maya Raghu, director of workplace equality and senior counsel at the National Women’s Law Center states, “If an employer is setting compensation for a job based on someone’s prior salary, then women and people of color are going to be carrying that wage disparity from job to job, and it’ll get amplified as time goes on.”. Henceforth it is very important to keep a previous employee’s salary disclosed unless she or he decides otherwise, otherwise, the employer could take advantage of it. The PFA would also require the Equal Employment Opportunity Commission (EEOC) to collect data on wage disparities. Often times the employers don’t the systematic discrimination in their ranks, and due that they believe that everything is fine. If women are to be paid less for no reason then employers must be held accountable for their actions by the system. One that will be caused by passing the Paycheck Fairness Act.
